Most personal injury claims involve the at-fault’s insurance company paying you money for your injuries and damages. In most personal injury cases, if you cannot settle your case you file suit against the at-fault party, not the insurance company. Furthermore, at trial, you do not get to mention, except in very limited situations, that the other person was even insured. The fiction at trial is that the at-fault person will pay any judgment out of his or her pocket. While there are some valid policy reasons for this, a lot is based on the strength of the insurance lobby. If a jury was told that all money would be paid by an insurance company they likely would give more money.
